
As I have said repeatedly, despite mischievous idiots trying to spin lies, the issue is NOT that I think Dele should not be sued for defamation. Afe has the right to sue. I believe so. I hope the deaf and the morons can hear me say this now clearly. Chief Afe has a right to sue.
The issue is the manner and the methodology in which this lawsuit has been carried out.The issues are:
1. Dele was not invited by police. He was abducted and kidnapped to Ekiti. Dele himself said he heard rumours of a court invitation but it was “hidden” from him to justify an arrest.
2. Criminal defamation does NOT exist in the state laws of Ekiti. Dele Farotimi was abducted to stand trial before a magistrate judge in Ekiti for a crime that does not exist in the state.
3. Dele was thrown in prison, or remanded in jail, for a crime that ordinarily the judge could have permitted bail for. Moreso, this crime does not exist in Ekiti. I have attached an article by highly respected Law Professor @ChidiOdinkalu which in my view is an eye-opening analysis of the Dele Farotimi situation.
When you look at all of the above points,You see that it clearly looks like someone is determined to torture, terrorise and dehumanise Dele simply to “show him” who is the boss.
This is why some of us have repeatedly said #FreeDeleFarotimi because of the perceived injustice in the manner that he has been treated so far.#FreeDeleFarotimi is not a defence of defamation or a request to escape the defamation lawsuit. It is a demand that the man be freed from an unlawful imprisonment so that he can rightfully face the lawsuit within the parameters of a just process.
When the very process of justice is tampered with, the outcome can no longer be trusted. You can not get justice from a process tainted with injustice. You can NOT build legality on illegality. Lawyers of all people, especially a SAN, should know something this basic.
A simple example is if you catch someone alleged of stealing and you start stripping them naked, using razor to slice their skin and putting pepper on it; I will strongly speak against it. If someone has stolen from you, take them to a police station and let them have their day in court. Do not dehumanise or terrorise the person on the basis of an alleged crime. This is my view. If Dele has defamed chief, then let the process for him to defend his claims be just and fair. Again, I hope the retarded morons accusing me of defending defamation now see the point now.
My position is that EVEN IF you say this person has defamed you, please pursue the defamation case within the parameters of fairness and justice.
