
A revolution is a sudden change of government without recourse to the legal and lawful means of changing of government.
If the constitution clearly states the way and manner a change can be effected in government, then any other means is illegal. So if a person, subject to the laws of Nigeria, makes a public statement that he is leading a revolution to change the government, in flagrant disobedience to the constitution of the country, should the government wait and allow him to carry out what he has professed to do. The constitution clearly states that this constitution is supreme and it’s provisions shall have binding force on all persons and authorities in this country.
It went further to say that no person or group of persons shall take over the government of the country except in accordance with the provisions of this constitution. And the provisions of the constitution for taking over of government has stated it clearly that it can only be by elections.
All other means is regarded as unlawful, illegal, criminal and unconstitutional.
When a Nigerian publicly makes a statement that he intends to take over the government through an illegal means, moreso, somebody who has attempted same through the legal means but failed, should government not be interested in what he has said. Don’t we feel he needs to make further statements to either confirm or deny his public statement.
Let us make a distinction between a revolution and a protest. Peaceful protest is democratic and lawful, but a revolution is unlawful and unconstitutional. Those that said Sowore should not have been arrested should please tell us, based on the law, what should be the reaction of government to his threat to over throw a legally constituted government.
We learn everyday and i am ready to learn here too. I will change my position too if I am properly educated better. I have stated the law as I know it, but not claiming to be an absolute authority. Atiku is in court because that is the legal way to seek redress, and Sowore has adopted another method to take over government, and we say he should be allowed to go ahead. The government will not allow him to go ahead. His arrest is not unlawful.
