
An Ekiti State High Court, sitting at Ijero-Ekiti, has fixed Thursday, 30th November, 2023, for the hearing of a Motion on Notice in respect of a suit on communal demarcation currently pending before the court presided over by Hon. Justice J.A. Apuabi.
In the substantive Suit No: HIJ/13/2023, filed by Mr. Olatunde Adejuyigbe, SAN, at the instance of Ipoti-Ekiti Community represented by the Olupoti of Ipoti-Ekiti, HRM Oba Oladipupo James Kolade and two other High Chiefs as Claimants with Ekiti State government and three others as Defendants, the Claimants are seeking against the Defendants declaratory and injunctive reliefs in respect of the land, property and institutions situated and located at Ipoti-Ekiti.
The orders of interlocutory injunction are being sought for the preservation of the ‘res’ and for all parties to maintain the status quo ‘ante bellum’ until the substantive suit is determined by the Honourable Court. It further said that the orders of interlocutory injunction be made so that the Honourable Court will not be presented with a ‘fait accompli’ by the time judgment is delivered in the substantive suit.
It would be recalled that the State Government under former Governor Kayode Fayemi granted autonomies to two of the three settlers in the community culminating into the community having three Obas in the area. The issue of land ownership has since been a source of friction among the three settlers subsequent to the grant of the said autonomies.
A date is yet to be set for the hearing of the substantive suit.
