BENIGNANT FORTE NIGERIA LIMITED has filed a petition at the Federal High Court, Port Harcourt Judicial Division, for voluntary winding-up of its business. The petition has been published in the Federal Gazette and 2 daily newspapers as required by law.
I have been made to understand that this step became necessary because the company avers that it was directed by the Securities & Exchange Commission to close its crowdfunding business platform as there is no legislation or regulation currently in place to guide the conduct of such businesses.
Benignant Forte Nigeria Limited maintains that it is still solvent and possesses sufficient assets, funds and receivables to fully amortize its obligations to its investors and creditors but wishes to prevent the typical panic that ensued when other companies with apparently similar business models halted payments to investors.
To foster investor confidence in its commitment to fully repay the capital sums (not return on investment) entrusted to it by its investors, Benignant Forte Nigeria Limited has stepped aside from the repayment process and applied to the Federal High Court to appoint a Provisional Liquidator to take over its businesses and bank accounts, dispose of its fixed assets, manage its businesses that generate recurring revenue and supervise the orderly repayment of investors’ funds.
On Monday, 22 November 2021, Federal High Court by order appointed me as Provisional Liquidator of Benignant Forte Nigeria Limited with a mandate to oversee the orderly repayment of investors’ deposits and wind up the company upon full repayment of all liabilities to investors. I have commenced the process of taking over all company assets and bank accounts. I have also commenced a full audit of the company’s bank accounts and financial transactions from start of business till date. If any malfeasance or impropriety is discovered, the perpetrators will be held fully accountable to the full extent authorized by law, no matter who is involved, and they will be made to refund any gains made from such activity.
I have also commenced the process of ascertaining the total number of investors, the amount(s) invested, the returns on investment paid (if any) to each investor and other relevant data. This will assist me in formulating and implementing a feasible schedule for repayment of investors’ funds.
To this end, if you invested any money in the company’s businesses, please use any of the channels below to register your claim for a refund:
OPTION 1. Retain a lawyer to file a notice of intention to appear on the petition.
Give your investment documents to the lawyer, who will use them to file your claim in the winding up proceedings at the Federal High Court, Port Harcourt Judicial Division. A copy of the winding up petition can be downloaded here. Give it to your lawyer, who will know what to do;
or
OPTION 2. Verify your email with the form below, with the unique link received, fill out the online claims form and upload your investment documents on the portal. These documents are:
a. copy of your valid, government-issued identification card;
b. copy of your certified bank statement showing the outflow to Benignant Forte Nigeria Limited; and
c. copy of any other document(s) issued to you by Benignant Forte Nigeria Limited when you made your investment;
or
OPTION 3. Download a copy of the claims form here. Fill it accurately, sign it and return it by email to [email protected] along with the following documents:
a. copy of your valid, government-issued identification card;
b. copy of your certified bank statement showing the outflow to Benignant Forte Nigeria Limited; and
c. copy of any other document(s) issued to you by Benignant Forte Nigeria Limited when you made your investment;
or
OPTION 4. Come to my office at No. 15 Mbonu Street, D/Line, Port Harcourt, Rivers State to fill out a claims form and submit the following documents:
a. copy of your valid, government-issued identification card;
b. copy of your certified bank statement showing the outflow to Benignant Forte Nigeria Limited; and
c. copy of any other document(s) issued to you by Benignant Forte Nigeria Limited when you made your investment;
or
OPTION 5. Go to any of the following addresses close to you to fill out a claims form and submit the documents already mentioned above:

I will hold a meeting with all creditors in December 2021 (date to be communicated to you via email, sms, WhatsApp, Facebook, Instagram, etc) to present my initial assessment of the time it will take to pay off all investors and creditors and the resources available to satisfy all claims. I trust that we will be able to agree on the path forward at that meeting.
This is not an open-ended process. Your claim must reach me on or before 22 December 2021 before it will be included in the repayment plan. Any claim submitted after that date can only be included by an order of the Federal High Court, which you will be responsible for obtaining.

NOTE:
To prevent multiple claim registrations and data conflicts, you will only be able to use ONE (1) email address to register your claim(s). Once you have verified your email address by clicking the link, you will not be able to use the same email address to register any other claim on the portal.
If you have already submitted your documents by email to [email protected] before reading this announcement, you ought to have received a claim registration form from that address. If you have not, WAIT. The form will be sent to you by email. Fill that form when you receive it, sign and return it to [email protected] to complete your claim registration. DO NOT SUBMIT THE SAME CLAIM THROUGH ANY OTHER CHANNEL. MULTIPLE CLAIMS ARISING FROM THE SAME INVESTMENT WILL BE DEEMED AS FRAUDULENT AND WILL NOT BE PROCESSED.
